Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a)398 W. Illinois St. - On or about 03/16/2011, employees were exposed to
crushing
hazards while operating a Caterpillar forklift without wearing a seat belt.
b)398 W. Illinois St. - On or about 03/16/2011, employees were exposed to
crushing
hazards while operating a Loadall forklift without wearing a seat belt.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to require employees to wear seat belts when operating forklifts as
referenced in ANSI B-56 1-
1913, Section 5.3.19:  An active operator protection device or system,
when provided, shall be
used.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included
with your
certification.  This documentation may include, but is not limited to,
evidence of the purchase
or repair of the equipment, photographic or video evidence of abatement,
or other written
records.t,
