General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)At the tank 834 site, employees were entering an elevated water tank in order to sandblast and paint. These hazards resulted from deficiencies in the implementation of the company's confined space entry program in that the company did not test the atmosphere of the tank for oxygen deficiency, flammables and/or toxics prior to initial entry. The company relied instead, on test results from an entry into a separate water tank.
