Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while working on unprotected elevated locations: West End, Barn #34 - On December 10, 2001, an employee working for the Bird Crew was not provided with fall protection when using the elevated trailer platform and was exposed to a fall distance of nine feet. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to install the post/chain guardrail system whenever the tailgate lift is operating. DECOSTER EGG FARMS AND ITS SUCCESSORS WAS INITIALLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD SECTION 5(A)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 300298734, CITATION NUMBER 1, ITEM 1 ISSUED ON 5/28/99 AND AGAIN ON A SECOND OCCASION AS NOTED IN OSHA INSPECTION NUMBER 300305125, CITATION NUMBER 1, ITEM 1, ISSUED ON NOVEMBER 30, 2000 WITH RESPECT TO A WORKPLACE LOCATED IN TURNER, MAINE.
