General-duty citation text
North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees condition of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to contact with live electrical conductors: a)in the outdoor receiving area, a Telemechanique pendant control box controlling the three-ton hoist, type, model number and serial number unknown, was cracked, exposing live conductors to the elements and dirt from workers hands. Among other methods, one feasible and acceptable method to correct this hazard would be to conduct daily inspections and correct any deficiencies noted so, in this case, the electrical components would not be exposed to dirt from the workers hands or to the elements, as indicated in ANSI B30.16-1981, Overhead Hoists (Underhung), section 16-1.2.2(c).
