North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish each of his employees a place of
employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical
harm to employees in that employees were exposed to being struck by
structural steel members
and other sections of fabricated metal components:
a)facility - workers performing tasks, such as welding, cutting and
grinding, in the
plant fabrication shops, and using electric chain hoists to move such
materials,
were exposed to being struck by materials as a result of hoists failures.
Hoists
were not inspected as required by ANSI B30.16-1968 to ensure that unsafe
operating conditions were identified and eliminated.
Among other methods, one feasible and acceptable abatement to correct the
hazard and to prevent the potential for serious injuries, is to implement a
regimented inspection program following the guidelines of ANSI
B30.16-1968.
