North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees condition(s) of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a wearing hip boots while riding in a boat: employees working on or near water are required to wear U.S.Coast Guard approved life jackets. Should an emergency occur, wearing hip boots while riding in a boat exposes the employee to water filling up the boots and this extra weight exceeding the capabilities of the life jacket. This condition occurred on 12/10/97, while employees were riding in an overloaded boat being unsafely towed to a logging site. The boat then capsized, causing an emergency condition of water entry. This condition resulted in the death of one (1) employee wearing hip boots. The employer did not take proper measures to ensure guarding against this condition. Among other methods, one feasible and acceptable abatement method to correct this hazard is establish this as a safety rule, to train employees with this safety rule, and utilize disciplinary policy where necessary to assure compliance.y

North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees condition(s) of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)operating a motorboat in a reckless or negligent manner so as to endanger the life of a person: using one (1) motorboat to tow a second boat (non-motorized) by a single point attachment to the bow. This condition occurred on 12/10/97, while employees were riding in an overloaded boat being towed in this manner to a logging site. The boat being towed then capsized, causing an emergency condition of water entry. This condition resulted in the death of one (1) employee. The employer did not take proper measures to ensure guarding against this condition. Among other methods, one feasible and acceptable abatement method to correct this hazard is establish this as a safety rule, to train employees with this safety rule, and utilize disciplinary policy where necessary to assure compliance. reference NCGS 75A-10 Boating and Water Safety!

Among other methods, one feasible and acceptable abatement method to correct this hazard is establish this as a safety rule, to train employees with this safety rule, and utilize disciplinary policy where necessary to assure compliance. reference NCGS 75A-6.1 Boating and Water Safety!
