Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being caught and/or crushed between the elevator shaftway and the car floor or falling into and being crushed in the shaftway itself: (a)At M & L Fabrics, the freight elevator was in service which had no rear car enclosure gate, no front enclosure gate on the first floor and a gate on the second floor which did not meet ANSI requirements in that it was not properly constructed and was not interlocked. The elevator had not had required maintenance inspections nor were there certificates of any such required inspections along with capacity plates, on or about 5/26/98. Feasible and acceptable methods to the correct the hazards are to Comply with ANSI A17.3-1986 and BOCA 1984 which would include insuring that the elevator has been repaired to comply with ANSI and BOCA in that the employer would conduct periodic inspections of elevators as stipulated by ANSI and BOCA to insure the integrity of the elevator and have documentation of such results including the posting of load rating and capacity plates. ABATEMENT CERTIFICATION & DOCUMENTATION REQUIRED FOR THIS ITEM.
