General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards due to improper use of the powered scissor lift: a) An employee was exposed to a fall hazard in excess of 7 feet while performing maintenance on a wall mounted ventilation exhaust fan while standing on the mid-rails of a scissor lift. In addition, the safety chains serving as the top rail and mid rail on one side of the platform were unfastened, leaving that side of the platform unguarded. Abatement Note: Among others, one feasible and acceptable means to abate this hazard is to comply with ANSI Standard A92.6-1990, American National Standard for Self-Propelled Elevating Work Platforms, which states that during operation of the aerial platform the user shall ensure that: 7.9 (3) The guardrails are installed and access gates or openings are closed per manufacturer's instructions. 7.11.1 Personnel shall maintain a firm footing on the platform floor while working thereon. Abatement Note: Abatement certification and documentation are required for this item (See enclosed "Sample Abatement-Certification Letter").
