Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a struck-by hazard:
Employees were exposed to a struck-by hazard due to the lower connection
pins
between the South side stinger insert section and the stinger butt section
were
removed during disassembly operations with the West end of the South side
stinger insert section not being blocked and the elevated X-Tender Beam
was also
not blocked or otherwise secured from movement.  This occurred at the J.
Ray
McDermott, Inc., closed Harbor Island Fabrication Yard, Hwy 361 Harbor
Island, Port Aransas, Texas 78373 on/or about April 04, 2000.  The employer
failed to control hazardous energy (e.g. potential mechanical energy) as
described
in American National Standard Institute (ANSI) Z244.1 1982 and "American
National Standard for Personnel Protection - Lockout/Tagout of Energy
Sources -
Minimum Safety Requirements."  This consensus standard is further
referenced
in the NIOSH Publication Number 83-125 1983, "Guidelines for Controlling
Hazardous Energy During Maintenance and Servicing (Lockout/Tagout)".
Among other methods, one feasible and acceptable abatement method to
correct
this hazard would be the development and implementation of a site-specific
Hazardous Energy Control Program (e.g. Lockout/Tagout LOTO) which would
also include employee training.
