Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to:
a. On or about June 16, 1998, at the job site located at Days Inn in East
Hazelcrest, IL., two
employees working in a Walter Payton Powerlift, Simon Constructor
CDA00249A, AT-45
aerial lift were not wearing safety harnesses and lanyards to prevent them
from falling out of
the basket to the ground.
A feasible and useful means of abatement includes, but is not limited to
the following action:
1. Ensure that all employees who work in an aerial lift are provided with
and use a safety
harness and lanyard which is correctly donned and used according to the
manufacturer's
