Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer failed to
provide a place of employment which was free from recognized hazards that
were likely to
cause death or serious physical harm to employees:
a.  On or about July 7, 1999, at the above address job site, an employee
doing work in a lift,
approximately 20 feet above the deck of a barge, was not wearing a safety
belt or any other
means of fall protection, as required by the American National Standards
Institute (ANSI
A92.5-1992), Standard for Boom-Supported Elevated Working Platforms.  The
employee was
thereby exposed to the hazards associated with falls of 20 feet to the
deck of the barge.
A Feasible and useful means of abatement includes, but is not limited to
the following action:
Ensure that all employees working in aerial lifts maintain a firm footing
on the platform and
use a safety harness and lanyard which is correctly donned and used
according to the
manufacturer's recommendations.
