Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being caught and/or crushed: a) Warehouse: Employees were exposed to the hazard of being caught and/or crushed between the elevator and shaftway wall or sills. Dowels were missing on car gates for elevator(s): 1) No. 1, Side A, dowel missing lower panel; 2) No. 3, Side B, 2 loose dowels upper panel; 3) No. 3, A side, 1 broken bottom panel. Violation observed on or about 3/3/99 Among other methods one feasible and acceptable abatement method to correct this hazard is to immediately replace or repair broken gate panels.
