Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to the employee in that he was exposed to a fall hazard.

A PSE&G employee was raised on a pallet by a forklift truck approximately
12-13 feet to
monitor the carbon monoxide levels generated by two ceiling mounted gas
powered heaters. The
PSE&G employee did not use an appropriate safety platform and was exposed
to the hazard of
falling 12-13 feet to the concrete floor as fall protection was not
provided.
Violation occurred on or about 03/19/99.
Abatement Notes: Among others, one suitable method for abating this
hazardous condition is 1)
Utilize only platforms designed for use in elevating personnel with
forklifts. These platforms
must meet the requirements set forth in ANSI/ASME B56.1-1993. 2) Train all
employees about
the hazards of falls associated with improper elevating methods, and the
proper application and
use of safety platforms.
This violation requires both certification and documentation as
appropriate proof of abatement.
