Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a) On or about 6/8/99, employees were exposed to fall hazards of 3 to 8
feet onto
concrete floors and onto steel shelving with protruding corners and edges
and to the hazards of
being struck by or crushed by falling ladder stands, stock, tools, and
equipment while moving,
mounting or dismounting and working on damaged ladder stands:  1) One
Ladder stand in the
stocking area of the paint department with steps bent making it unstable
to mount or dismount.
2) Three Ladder stands in the Lumber / Building Materials area of the
store with one or more
of the following conditions: bent frames, frame welds missing, and
guarding on the top platform
missing making them unstable to use.  3)  One ladder stand in the Plumbing
department
with
a frame weld missing on a leg, making the ladder unstable to use.  4) Two
ladder stands in the
Gardening area of the store with damaged casters, rubber tips missing on
the legs, and
nonfunctioning brakes.
b) Employees were not trained by the employer on how to properly inspect,
utilize, and
maintain Cotterman step platform ladder stands to prevent fall hazards,
which directly
contributed to the injury of 2 workers in the store.
An example of a feasible abatement method, among other methods, would be
to remove the
ladders from service until repaired in accordance with the manufacturers
instructions and by
following the inspection, proper setup, and usage guidelines established
by the Cotterman
Company in inspecting and utilizing their ladder stands.
