Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Employees were exposed to fall hazards presented by working on damaged Cotterman ladder stands in the stocking, sales, lumber/building materials, plumbing, and garden departments of the store. b) Employees were not trained by the employer on how to properly inspect and maintain Cotterman step platform ladder stands. One feasible abatement method, but not limited to, would be to follow the guidelines established by the Cotterman Company in inspecting and utilizing their ladder stands.
