Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: falling from the elevated forks of a forklift truck. (a)Warehouse - Employees were transported on and worked from the elevated forks of Caterpillar lift truck (*WMO1231*, Model Number TH63) without using a personnel platform with a guardrail system or a personal fall arrest system. Among other methods, one feasible and acceptable method to correct this hazard is to prohibit the transporting of employees on forks of lift truck and prohibit employees from working from the forks of a lift truck.
