Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of falling form heights inexcess of 15 feet
while climbing the
guardrails and stepping over to a roof from a self-propelled elevating
work platform.
There are numerous ways to abate the hazard of falling including but not
limited to following
the ANSI A92.6 - 1990 (or newer), Sections 6, 7, and 8 which address
inspection, training and
safe operation requirements to be followed.
