Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) exposed to being struck by a falling piece of ductile pipe: (a)On October 21, 2000, two employees were using a backhoe to move a piece of ductile pipe to a trench for installation. The chain used to lift the pipe was not properly attached to the backhoe bucket. In order to lift the pipe, a chain had been looped around the bucket of the backhoe. During the transport of the pipe, the chain came loose and the pipe fell, striking and breaking the leg of one employee working in the area. Among others, one feasible and acceptable method to correct this hazard is to follow the manufacturer's guidelines for proper chain attachment to the backhoe bucket, found in the John Deere 31OSE Backhoe Loaders' Operator Manual.
