North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)cabling department--a Dayton 1/2 ton monorail hoist and the supporting structure had not been provided with an initial operational test prior to being placed into operation. REFERENCE:ANSI/ASME B30.11-1980, section 11-2.2 Prior to initial use, all new, extensively repaired or modified equipment shall be tested to assure compliance with this standard. NOTE:Among other methods of abatement, one feasible and acceptable method to abate this hazard is to have the hoist and supporting monorail structure load tested to ensure the maximum weight of 1,000 pounds can be supported. The record of the test is required to be made available upon request.e
