North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:
a) 201 Clingman Avenue, Asheville -- roof of building: 2
employees came in contact with energized power lines.
Employer did not instruct each employee in the
recognition and avoidance of unsafe conditions and the
regulations applicable to his assigned work environment
to control or eliminate any hazards or other exposure to
illness or injury.
NOTE:Among other methods, one feasible and acceptable
method to correct this hazard is for the employer
to instruct his employees in the recognition,
elimination and avoidance of hazard.
in the alternative, 29 CFR 1926.416(a)(1); Employees were
permitted to work in proximity to electric power circuits and were
not protected against electric shock by deenergizing and grounding
the circuits or effectively guarding the circuits by insulation or
other means.
