Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the following condition(s):
a)  Hymel Farms - Rienzi Plantation, Thibodaux, LA:  For the period of
time up to and
including September 19, 2000, a John Deere Model #4230, Serial
#RW4230P028150R
tractor was not maintained in proper working condition.  The tractor's
start circuit did
not meet the original manufacturing configuration.  The wiring to the
neutral start switch
and other electrcical systems had been removed, preventing the operation
of the tractor's
key ignition system.  The condition required employees to start the
tractor's engine by
shorting across the solenoid terminals, exposing the employees to the
hazards of being
struck by and/or being crushed by the tractor due to bypass starting.
Among other methods, one feasible and acceptible abatement method to
correct the
hazard is to develop a program that would ensure the proper maintenance
and repair of
farm field equipment.
