Section 5(A)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish to employees employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees:
The vehicle repair shop: On or about July 12, 2000, an employee was
working on a Dover
Rotary Automotive Lift at a height lower than approximately 66 inches
where the safety device
engages in the riser portion of the device to prevent the lift from
lowering on an employee in
case of device failure.
Among other methods, one feasible and acceptable method to correct this
hazard is for the
employer to: 1) Ensure that the employees utilize the safety latch device,
2) that the employees
always use appropriate jacks if the lift needs to be set at a height lower
than when the safety
latch device engages.  The above is specified in the following document:
