Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to moving industrial trucks: Plant Yard Area - Earth moving machines (trucks) were not withdrawn from service until restored to proper operating condition, in that, 1/ 'PC300 Komatsu' Excavator b/ Three(3) mirrors which allowed the operator to see the sides and back of the 'machine' were still broken. 2/ 'WA500 Front Loader' a/ The wind shield (side panel) was still broken. Observed 10/05/01. One feasible and acceptable method to abate this condition is to have all of the machines (trucks) repaired immediately, and/or removed from service until restored to proper operating condition.
