North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees, in that
employees were exposed to the hazards of having their fingers,
hands, or other body parts being caught in the point of operation
of machinery.
Power Press Brake - a Trumpf, Truma Bend V230, Hydraulic
press break, Serial Number F1016F, was not provided with
a operational guard for the point-of-operation which on
or about April 10, 2000 resulted in the injury to a
temporary employee. (Ref. ANSI B11.3-1982 (R1994)).
one feasible and acceptable method, among others, to
correct the hazard is to make sure that only fully
trained and qualified employees are allowed to operated
the press brake and all safety devices are operable.
