Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about 05-09-00 at 7322 Jones Maltsburger, San Antonio, TX an employee was observed working on a work platform being elevated by a forklift truck. The hazard of falls exist in that the employee was working from a work platform which was not secured to the fork truck. Among other feasible and useful methods to abate the hazard, one method would be to properly install a safety/work platform approved by the manufacturer.
