Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a) On or about September 14, 2000, and in times prior thereto employees
serviced
dumpsters at a construction site after dusk and before daylight where no
artificial illumination
was provided in the work area. Among other feasible and useful methods of
abatement, one
method of abatement would be to inspect the jobsite for lighting
provisions and provide
flashlights as mandatory equipment as needed.
or in the alternative:
29 CFR 1926.56(a):  While work was in progress, construction areas, ramps,
runways,
corridors, offices, shops or storage areas were not lighted to the minimum
illumination
intensities listed in table D3 of subpart D of 29 CFR part 1926:
a) At the southeast side of the jobsite, there was no provision for
lighting sufficient to
inspect and service the roll-off containers.  A streetlight adjacent to
the site was not close enough
as to provide a minimum of three footcandles of light in the waste area.
On about September 14,
2000 and in times prior thereto, employees serviced the containers after
dusk and before
daylight.
ABATEMENT NOTE: The American National Standards Institute Practice for
Industrial
Lighting Table 1 requires 50 footcandles of light for simple inspection
activity.
