Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: a. Receive injuries due to failure of the hoisting and lowering structure, equipped with a welded frame load-carrying unit platform, linked by a chain to an overhead electric hoist, trademark Milwaukee, model: 9573, serial number MJL-157-JA, 2 tons cap.; used by employees to perform lifting operations to transport merchandise and other goods; was not certified as to comply with the requirements specified in ASME A17.1-1990 and PR Special Rule #5. Among others methods, one feasible and acceptable abatement method to correct this hazard is the use of a lifting equipment that meet elevator requirements in ASME A17.1-1990 and Special Rule #5. a. Recibir lesiones debido a fallo de estructura para izar y bajar equipada con una unidad de acarreo de plataforma en marco soldado, unido por una cadena a una pateca electrica de techo, marca Milwaukee, modelo: 9573; numero de serie MJL-157-JA, 2 toneladas de capacidad, usado por empleados para realizar operaciones de izar, transportando mercancia y otros utiles; no estaba certificado en corformidad con los requisitos especificados en ASME A17.1-1999 y la Regla Especial #5 de PR. Entre otros metodos, un metodo aceptable y factible para corregir este riesgo es el uso de un equipo de izar que cumpla con los requisitos en ASME A17.1-1999 y la Regla Especial #5.
