Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to oxygen deficient and/or dangerous accumulations of toxic
substances during
confined space entry:
a)  On and prior to January 19, 2001, employees of the company entered
various
sewer vaults for the purpose of setting up and removing sewer pipe
alignment
instruments.  At the time of entry, the company did not have a confined
space
entry program to include:
1)  A confined space entry permit system.
2)  Employee training with respect to the hazards associated with entering
confined spaces or, with the methods that they could use to minimize these
hazards.
3)  Atmospheric testing for oxygen deficiency, flammable gas, and air
contaminants was not conducted prior to entering confined spaces.
4)  An emergency response rescue program was not developed or implemented.
Among other methods, one feasible and acceptable method to abate these
hazards is to develop
and implement a confined space entry program which meets the criteria of
Safety Requirements
for Confined Spaces, American National Standards Institute (ANSI
Z117.1-1989).

were exposed to being struck by the rotating structure of an excavator.
a)  On or about January 18th, 2001 an employee of a sub-contractor received
serious injuries after being struck by the rotating structure of a Hatachi
330LC
excavator.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard is to follow the Hatachi owner/operators manual which states
that
"before operating this machine, set up barrier's to the sides and rear
area of the
bucket swing radius to prevent anyone from entering the area."
