P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed by a powered industrial truck in the event of turnover: a) Yard area/ material area - Employees were operating a 1989 Caterpillar Model 936E Wheel Loader, S/N 33Z04342, that was not equipped with a seat belt. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install seat belts on the front-end loader and require employees to wear the seat belt while operating the equipment.
