Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing or struck by hazard: Vehicle Maintenance Shop - The overhead rail for the 2 ton P&H electric hoist used to lift the in-shop made septic tanks did not have the capacity rating marked on the rail: Among other methods, one feasible and acceptable abatement method correct this hazard is Under ASME B30.16-1998 Overhead Hoists section 16-1.3.2, "The support structure, including trolley, monorail, or crane, shall be designed to withstand the loads and forces imposed by the hoist for the rated load." The overhead rail for the 2 ton P&H electric hoist is part of the support structure. The load rating capacity calculation for the overhead rail must be performed by an appropriate professional engineer. Once the load rating calculation has been established, the rating shall be marked on the overhead rail.
