29 CFR 1910.106(b)(6): In locations where flammable vapors may be present, precautions were not taken to prevent ignition by eliminating or controlling sources of ignition:   On or about 11/26/2013, an explosion/fire occurred in and around a heated asphalt storage tank containing kerosene, and in the following instances precautions were not taken to eliminate or control sources of ignition:   a) Batch Plant - A Carlin burner was located below the vents and inside the diked area of the asphalt tank.  b) Batch Plant - The wiring, fittings, and motors located below the vents and/or inside the diked area of the asphalt tank were not intrinsically safe.

29 CFR 1910.307(c): Equipment, wiring methods, and installations of equipment in hazardous (classified) locations were not intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location:   On or about 11/26/2013, an explosion/fire occurred in and around a heated asphalt storage tank containing kerosene, and in the following instances the electrical components were not approved for the hazardous (Class 1) location:   a) Batch Plant - A Carlin burner was located below the vents and inside the diked area of the asphalt tank.  b) Batch Plant - The armored cable located below the vents and above the diked area of the asphalt tank.  c) Batch Plant - The hot oil circulator pump motor located below the vents.  d) Batch Plant - The asphalt pump motor located below the vents and inside the diked area of the asphalt tank.
