North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment and
a place of employment which were free from recognized hazards that were
causing or likely to
cause death or serious physical harm to employees in that employees were
exposed to:
a)falling into trench located at corner of Midnight Lane and Bluefield
Road -
employees responding to a call for rescue/retrieval did not follow the
emergency
response plan led by the Incident Commander and Safety Designee for the
site,
which was designed to protect the safety of each responding employee.
NOTE:Among other methods, one feasible and acceptable method to correct
this
hazard is to follow the requirements set forth in the following reference.
REFERENCE:1910.120(p)(8)(ii) elements of an emergency response plan:
(A) Pre-emergency planning and coordination with outside parties.
(B) Personnel roles, lines of authority, and communication.
(C) Emergency recognition and prevention.
(D) Safe distances and places of refuge.
