North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to the hazard of being struck-by Bobcat skid steer loaders:
a)Glenwood Cemetery, 1/7/05, employee was struck by a lift
arm of a Bobcat, Model #773, skid steer loader that was
being operated by an employee who was not trained in the
safe operation of the loader.
Among other methods, one feasible and acceptable
abatement method to correct this hazard is to (a) follow
the manufacturer's instructions in the Bobcat Operation
and Maintenance Manual for Model #773, "Before Operating
the Bobcat Loader," page xii which states that "a
qualified operator must understand the written
instructions, rules and regulations, have training with
actual operation, and know the work conditions."
b)Glenwood Cemetery, 1/7/05, employee was struck by a lift
arm of a Bobcat, Model #773, skid steer loader that was
not being properly operated.
Among other methods, one feasible and acceptable
abatement method to correct this hazard is to follow the
instructions in the Bobcat skid steer loader operator
training course handbook which states on page #13 in the
heading of Safe Traveling, "Never start moving until you
are sure that no one is in your path.  Look ahead, to the
sides, and behind you so that you know where everyone
is."yone
