Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees, employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the hazard of being crushed. Dock, Toyota diesel power forklifts - Employer does not enforce the use of seatbelts by all operators. Hazard of being struck by equipment. Observed on or about January 9, 2001. Feasible and acceptable method of abatement: Where seat belts are provided on forklifts, enforce the use of seat belts. ABATEMENT DOCUMENTATION AND CERTIFICATION REQUIRED
