Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by a falling brace:
a.On or about July 24, 2002, the employer selected and installed Dayton
Superior
T-13 expansion anchor bolts which were not appropriate for use with the
Meadow-Burke engineered brace system. This could cause the brace to
separate
from its anchor point on the concrete column, and fall onto an employee.
b.On or about July 24, 2002, the employer did not use a torque wrench to
install
the Dayton Superior T-13 expansion anchor bolt onto the brace system. This
could cause the brace to separate from its anchor point on the concrete
column,
and fall onto an employee.
Among other methods, A feasible means of abatement would be:
1.Use an anchor bolt that is designed and recommended by the manufacturer
of the brace.
2Use a torque wrench to apply and measure the amount of torque applied
to the anchor bolt in accordance with the manufacturer's recommendation.
ABATEMENT CERTIFICATION IS REQUIRED.TION
