Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall injuries from substandard railings, multiple injuries
or death from the
unsecured platform displacement on the rough terrain fork lift, and
multiple injuries or death
from a tipping over hazard using an oversized platform on a rough terrain
forklift truck:
(a) Employees were exposed to multiple injuries and death hazards created
by the use of elevated
work platform which were not designed, constructed and or used in
accordance with the
acceptable requirements of the American National Safety Standard for rough
Terrain Forklift
Trucks, ASME/ANSI B56.6a-1994 and other acceptable industry practices. For
example: The
platform used did not meet the following design and use requirements of
sections 8.25 and 5.15
of ASME/ANSI B56.6a-1994 in the following areas: (1) Platform dimensions
exceeded in width
more than 10 inches greater than the overall width of the truck on either
side and exceeded two
times the load center distance, (2) Did not have toe plates, (3) Did not
have the maximum work
load and empty weight information prominently marked on the platform, (4)
The platform was
not attached to the forks or lifting mechanism, (5) Did not have a midrail
and/or a body belt and
lanyard used when guardrails were omitted, (6) Controls were not installed
on the elevating
platform nor an operator at the truck controls while an employee was
elevated, (8) The path of
travel was not clear of power lines.
The above conditions were observed when an employee was installing soffit
and facia at the roof
eve of the site in a platform attached to the Highlander rough terrain
forklift truck platform
suspended over 11 feet from ground level.
Among other methods, feasible and acceptable means to correct these
hazards
are to use safer
alternative methods such as a scaffold or use a platform approved by the
manufacturer meeting
the design, manufacture, and use requirements of ASME/ANSI B56.6a-1994 for
all attachments
on rough terrain forklifts.
