North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:
a)facility wide, below-the-hook lifting devices were not
inspected by a designated person to ensure compliance
with ANSI/ASME B30.20, Below-the-Hook Lifting Devices, in
that the lifters were designed to withstand the forces
imposed by its load, with a minimum design factor of 3,
based on yield strength, for load bearing structural
components.
Among other methods, one feasible means of abatement is to
allow a register professional engineer inspect below-the-hook
lifting devices used at the facility to determine the devices'
safe lifting capacity.
