Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to being struck by the rotating superstructure of an excavator: Job Site: Edge of excavation. Employees were exposed to being struck by the rotating superstructure of a Kobelco SK330LC excavator where swing radius protection was not utilized. One method of abatement, among others, would be to erect a barrier around the area of swing to prevent employees from entering the danger zone.r
