Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to hazards of struck-by and falls from moving equipment. (a)Super Walmart Construction Site - Employees were exposed to struck-by and fall hazards while standing on the side-step of a JLG/Gradall G6-42A Material Handler and riding around the rough-terrain jobsite on April 18, 2002. (b) Super Walmart Construction Site - Employees were exposed to struck-by and fall hazards while sitting in the rear-wheel hub of an unidentified front-end loader while traveling on rough terrain on April 16, 2002. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to prohibit any employees from riding on heavy equipment as passengers.
