Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At this facility: The employer manages approximately 10 (ten) forklifts of various design and sizes. These lifts are used in the mill and outside the mill, on rough and slippery terrain and during all seasons of the year and in inclement weather conditions. The areas in which the lift operate are inclined with little to no flat or even surfaces. The employer has failed to require the use of seatbelts on these lifts in spite of the fact they are provided by the manufacturer. Recognition of the hazard of forklift tip over and the need for operators to use an operator restraint system is evidenced by certain requirements in the more current version of ANSI B56.1-2000 - Safety Standard for Low Lift and High Lift Trucks.d
