Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)The hazard of possible unexpected movement of the machine and/or the load due to the operator not being in attendance while the forks were elevated with personnel on the platform. Among other methods, one feasible and acceptable method to correct this hazard would be to follow the guidelines set forth in ASME B56.6-1992, Section 6.2 and to keep the operator withing 25 feet and visual contact with the controls.
