Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazard of being crushed by forklifts that were not provided with seat belts: a) A seat belt was not provided on a Clark forklift (serial number 4355-040-4545FA) in use at the site. b) A seat belt was not provided on a Taylor heavy duty forklift (serial number 3-86- 2916; model number 4-14W). Employees were exposed to being crushed by the machines in event of tip over. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that seat belts are installed on these machines.
