Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees
in that employees
were exposed to the following conditions:
a)On or about February 18, 2003, at Bosworth Papers, Inc. located at 6300
West
by North West Blvd, Houston, TX an employee who work on a pallet which had
been placed on the fork of a Reach-Fork Truck for the purpose of elevating
himself to retrieve supplies from shelves. The employer did not ensure
that the
employee was protected from the hazards of falling by using some type of
restraining means.
Among other methods, one recognized and feasible means of abatement to
correct the hazard
include, but are not limited to:
As referenced by ASME B56.1-2000, Part 4.17.2(c): Whenever a truck is used
to elevate
personnel, the following precautions for the protection of personnel shall
be taken:
Be certain that required restraining means such as railings, chains,
cables, body belt(s) with
lanyard(s), or deceleration devices, etc., are in place and properly used.
