Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the load should the overhead hoists, lifting devices, or the monorail systems fail: a)On or about 01/17/2002, the Battery Area had one below-the-hook spreader beam lifting device rated at 6000 lbs capacity that had a safety latch missing and no periodic or frequent inspection was being performed with no record or external identification code marks being maintained. Among other methods, feasible and acceptable methods to correct each of these hazards are to: 1.Replace the safety latch on the hook 2.Conduct frequent and periodic inspections of the lifting device in accordance with ASME B30.20-1993, Chapter 20-1, and an external code mark or a record be maintained for identification. b)On or about 01/17/2002, the following overhead hoist monorail structures had no rated load capacity markings on them and the capacity had never been determined: 1.Maintenance Department, 1/2 ton Milwaukee electric hoist attached to an 'I' Beam rail running the length of the department had been welded to the roof joists and had no rated load capacity markings on it. 2.Whey Plant, two 1 ton CM electric hoist and two 1/2 ton manual hoists attached to beam rails used to lift motors and container covers had no rated load capacity markings on the monorail structure. Among other methods, several feasible and acceptable abatement methods to correct these hazards are to: 1.Test all new, extensively repaired, modified or altered equipment prior to initial use by or under the direction of an appointed person and with a written report furnished by such person confirming the load rating of the system. 2.Mark the rated load on the main structure in accordance with ANSI B30.11-1973, Chapter 11-1. c)On or about 01/17/2002, the following electric and manual hoists used for lifting motors, container covers and other miscellaneous items of equipmenthad no annual or frequent inspections conducted with no records being maintained: 1.Whey plant, two Milwaukee 1 ton and two 1/2 ton overhead electric hoists, serial numbers unknown had no annual or more frequent inspections being performed with no maintenance records, 2.Whey room, one 1/2 ton CM Lode Star electric overhead hoist, serial number unknown had no annual or frequent inspections performed with no maintenance records. Among other methods, feasible and acceptable abatement methods to correct this hazard are to: 1.Conduct frequent and periodic inspections of all hoisting equipment. 2.Maintain dated inspection reports or comparable records on critical items such as hoisting machinery and other lifting devices in accordance with ANSI B30.16-1987, Chapter 16-2. Abatement certification must be submitted for these items.
