Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being thrown from the operator's compartment or being struck by loader: a)At the facility, on or about 3/15/02: Employee operating a Case 1845C Uni- Loader, was not wearing the seatbelt provided. b)At the facility, on or about 3/15/02: Employee operating a Case 1845C Uni- Loader and the audible backup alarm was not functioning. Among other methods, some feasible and acceptable methods to correct this hazard is to: (1) Ensure that the loader is in good operating condition and that all its safety equipment is correctly installed and utilized; (2) Ensure that every operator is familiar with the safety equipment to include its function and purpose; and (3) Instruct operators to report malfunctions or unsafe conditions prior to operation.
