Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY THE LOAD : a)On or about 10/04/2002, the overhead lifting platform hoist, from first floor to second floor storage, a Dayton 1 ton overhead hoist had a non-functioning upper and lower safety limit devices. b)On or about 10/04/2002, the overhead lifting platform hoist, from first floor to second floor storage, a 1 ton Dayton electric hoist, was not being inspected frequently or periodically. Among other methods, several feasible and acceptable abatement methods to correct these hazards are to: 1.Repair or replace the upper and lower safety limit devices. 2.Conduct frequent and periodic inspections of the hoists in accordance with ANSI B30.16, Chapter 16-2.1.2-1987 Overhead Hoists. c)On or about 10/04/2002, the below-the-hook lifting platform which was connected to a 1 ton electric Dayton overhead hoist was not rated for a specific load and the lifting device was not marked with the rated load. d)On or about 10/04/2002, the below-the-hook lifting platform which was connected to a 1 ton Dayton overhead hoist was not periodically inspected and records being maintained. Among other methods, several feasible and acceptable abatement methods to correct these hazards are to: 1.Mark the rated load capacity on the main structure in accordance with ANSI B30.20, chapter 20-1.2-1993 2.Conduct frequent and periodic inspections of the below-the-hook lifting device and maintain records in accordance with ANSI B30.20, chapter 20-1.3-1993 Below-the-Hook Lifting Devices. Abatement certification must be submitted for these items.
