Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of injuries in the event of a tip over accident while operating a powered industrial truck on or about 11/13/02. "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS": 1) Instruct each employee during initial training and safety meetings, to use the operator restraint system (seatbelts) in accordance with The National Safety Council lift truck operators course and the DSC Logistics safety policies and procedures manual. 2) Conduct periodic monitoring inspections of forklift drivers and correct deficiencies immediately.
