Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by motor vehicles.
On or about January 20, 2003 in and along U.S. Highway 76, Young Harris,
GA; An employee
performing road maintenance work, while operating a Toro Groundmaster 325
traction unit was
exposed to the hazard of being "struck by" passing vehicular traffic. The
employer did not
ensure that a temporary traffic control zone was properly established.
Among other methods, recognized and feasible means of abatement to correct
this hazard
include, but are not limited to:
Full implementation of the applicable elements required by the Manual on
Uniform Traffic
Control Devices (MUTCD), Part 6, Section 6G, Temporary Traffic Control,
