Nevada Revised Statute 618.375(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The employer failed to ensure that the work-site was free from recognized hazards: a.Westbound right and middle lanes of the Lake Mead Blvd. overpass adjacent to Rainbow Blvd. Two employees on a platform of a S-40 Genie Lift (boom-supported elevating work platform), at a height of approximately 13 feet, were working over a traffic lane that had not been barricaded off from oncoming traffic. As a result, a tractor trailer struck the platform, two employees were ejected, fell to the concrete surface and Employee #1 sustained fatal injuries. ANSI A92.5-1992, paragraph 7.11.2 & 8.10.2, copy of standard found in the Genie Lift storage compartment: "Precaution from other moving equipment. When other moving equipment or vehicles are present, special precautions shall be taken to comply with local ordinances or safety standards established for the workplace. Warnings such as, but not limited to, flags, roped-off areas, flashing lights, and barricades shall be used." Among other methods, one feasible and acceptable abatement method to correct this hazard would be 1) Employees request that the General Contractor move the barricades to completely enclose the work area as they had requested in the past and train each employee on these requirements.

Nevada Revised Statute 618.375(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The employer failed to ensure that the work-site was free from recognized hazards: a.Westbound right and middle lanes of the Lake Mead Blvd. overpass adjacent to Rainbow Blvd. The two employees, though wearing a full body harness and lanyard, were not anchored to the S-40 Genie Lift platform. As a result, when a tractor trailer struck the platform, the two employees were ejected, fell to the concrete surface and Employee #1 sustained fatal injuries. ANSI A92.5-1992, paragraph 8.8(g), copy of standard found in the Genie Lift storage compartment: "During operation. The aerial platform shall be used in accordance with this standard. The operator shall ensure the following before each elevation of the platform: Ensure all personnel in the platform are wearing fall protection devices and other safety gear as required at all times." Genie S-40 and S-45 Operator's Manual, Second Edition, page 4, found in the Genie Lift storage compartment: "Attach lanyard to anchor provided in platform." Among other methods, one feasible and acceptable abatement method to correct these hazards would be 1) Ensure that employees have attached their lanyard to the provided anchorage point prior to elevating the platform by retraining each employee in accordance with the ANSI A92.5 and Operator's Manual for each lift, "cherry picker", etc., rented or owned by the company.
