(a) At the Desert Construction Hualapai Asphalt Batch Plant, electrical wires, cabling, hoses and other equipment were on the ground in walking/working areas and the platform used to access the aggregate bins.

29 CFR 1910.106(e)(6)(i):  Adequate precautions were not taken to prevent the ignition of flammable vapors:    (a)  At the Desert Construction Hualapai Asphalt Batch Plant, asphalt drum mixer, flammable vapors were created when diesel fuel was sprayed into a hot mixing drum and precautons were not taken to ensure the drum was adequately cooled and all potential ignition sources were eliminated including the potential for static discharge.

29 CFR 1910.146(c)(2):  The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence, location of and the danger posed by the permit spaces.    (a)  At the Hualapai Asphalt Batch Plant, confined spaces, including but not limited to the chute to the maintenance hatches into the hot mix squirrel cage conveyor, were not marked with a sign reading DANGER-PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER or other similar language.

(a) At the Hualapai Asphalt Plant, employees were required to enter permit spaces, including but not limited to, the asphalt hot mix squirrel cage conveyor to perform maintenance and cleaning operations and the employer did not develop and implement a written permit space entry program per 1910.146(d) for the task.

29 CFR 1910.147(c)(4)(ii)(C):  The energy control procedure did not clearly and specifically outline the steps for placement, removal and transfer of lockout devices or tagout devices and the responsibility for them:    (a) At the Desert Construction, Hualapai Asphalt Plant, the employer's energy control procedure failed to include clear and specific procedural steps covering the placement of lockout devices and tagout devices including the requirement for employees to indicate the identity of the employee applying the device(s).  Maintenance employees are exposed to mechanical and electrical hazards while maintaining and repairing generators, asphalt mixing drums and chutes and squirrel cage conveyors and tagout devices do not clearly identify the employee(s) involved in the lockout/tagout procedure.
